LS Direct is a full-service direct marketing company.  We specialize in marketing data, predictive analytics and marketing technology to target the right customer with a highly personalized message when they are most likely to buy. We do this through the aggregation of a number of data sources which help us to determine the offers most likely to be relevant to you.

As such, we may share the data we collect with our marketing partners for use in tailoring their marketing efforts. As part of our service to you, we feel that it is important to empower you with control and inform you about the use of the personally identifiable information (“PII”) collected during this process.

PII is defined by the U.S. Office of Management and Budget as:

“…information that can be used to distinguish or trace an individual’s identity, either alone or when combined with other personal or identifying information that is linked or linkable to a specific individual. The definition of PII is not anchored to any single category of information or technology. Rather, it requires a case-by-case assessment of the specific risk that an individual can be identified. In performing this assessment, it is important for an agency to recognize that Non-PII can become PII whenever additional information is made publicly available — in any medium and from any source — that, when combined with other available information, could be used to identify an individual”

Although the above definition of PII is quite broad, we assure you that with any data we collect such as your email address, IP address, mailing address, purchases made, and online activities (“Data”), we are following a meaningful set of policies that provide you with the tools you need to control the information that we collect about you.

OFFLINE PRIVACY POLICY

All user data utilized by LS Direct Marketing in support of our direct mail services (i.e., List Management, List Brokerage and List Fulfillment) is received from our Marketing Partners.  The data we receive from our Marketing Partners may include: name, address, and email address. At times, we may combine the data received from our Third-Party Marketing Partners with data that we collect (“Data”). Our use of Data is limited to the uses allowed under the operative Third-Party Marketing Partner’s privacy policy that applies to the subject data collection.

How We Use Collected Data

We may provide Data to Marketing Partners we work with to bring selected retail opportunities to our users. These partners may include but are not limited to: (a) providers of direct marketing services and applications, including lookup and reference, data enhancement, suppression, and validation; (b) direct marketers.

We may also employ other companies and individuals to perform certain functions on our behalf. Examples include sending direct mail, removing duplicate information from user lists, analyzing data and providing marketing analysis. The agents performing these limited functions on our behalf shall have access to the Data as needed to perform their functions for us, but we do not permit them to use capture data for other purposes.

We may use capture data for internal business purposes, such as analyzing and managing our business.  We may also combine the Data with information from other sources including, without limitation, our Third-Party Marketing Partners.

We reserve the right to release current or past user Data in our possession in the event we believe the user is using or has used, our products, services and/or website: (i) in violation of the LS Direct Marketing Site promotion contest rules, this Privacy Policy or any other of our operating rules, policies, price schedules and other supplemental terms and conditions or documents that may be published by us from time to time; (ii) to commit unlawful acts; (iii) if such information is subpoenaed or requested pursuant to a judicial or regulatory proceeding or inquiry; and/or (iv) if we are involved in a sale, acquisition,merger, reorganization or sale of assets or in the event of bankruptcy.

Behavioral Targeting/Uses of Data

LS Direct Marketing reserves the right to share, rent, sell distribute and/or use capture data for any and all lawful purposes. Without limiting the foregoing, LS Direct Marketing reserves the right to utilize user data to develop and deliver our products and services, develop and deliver the products and services of our Third-Party Marketing Partners, and to fulfill legal and regulatory requirements.

Security

We endeavor to safeguard and protect our users’ information. The privacy of capture data is very important to us. The servers that we store Data on are kept in a secure physical environment. We have security measures in place to protect against the loss, misuse and alteration of Data under our control. Unfortunately, no Data transmission over the Internet can be guaranteed to be 100% secure. As a result, while we strive to protect capture data, we cannot ensure or warrant the security of any Data transmitted to us.

However, access to capture data is strictly limited, and not accessible to the public. Our Marketing Partners’ Data is restricted. Only employees who need the information to perform a specific job function are granted access to Data. Our employees are dedicated to ensuring the security and privacy of all user Data. Employees not adhering to our firm policies are subject to disciplinary action. We shall notify you in the event we learn of an information security breach with respect to capturing data. You will be notified via email or postal mail in the event of such a breach. Please be advised that notice may be delayed in order to address the needs of law enforcement, determine the scope of network damage, and to engage in remedial measures.

Privacy of Minors

We do not knowingly collect or receive user Data from minors. We encourage parents and guardians to spend time with their children and to participate and monitor the activities of their children.

 

Suppression of Capture Data/Opting Out

At your request, we will inform you of what Data we have on file for you. In addition, at your request, we will make unavailable for future use by us any user Data that our Marketing Partners have provided to us. You may contact us by clicking here and completing this form. Please provide us with your name, street address, email address and the nature of your request. Please be advised that opting-out of receipt of communications from us or third parties will only change or delete the Data contained in capture database for purposes of managing future offline communications from us. These opt-out requests will not change or delete Data which may have already been shared with third parties, all as provided above in this Privacy Policy. You will need to contact the third parties that contact you directly to change your preferences regarding their use of capture data. California Residents have additional rights and should see the section below.

Information sent via offline means is prepared several weeks in advance. Your preference will be noted in our records within seven days but may not impact information that has already been provided to our Marketing Partners. As such, you may continue to receive offers from us or our partners for up to ninety (90) days following the unsubscribe procedures detailed above. ONLINE PRIVACY POLICY

We, along with our Third-Party Marketing Partners, employ cookies and pixels and/or small pieces of code known as “web beacons” or “clear gifs” that may be incorporated into LS Direct Marketing creative, Third Party Marketing Partners’ emails, and Third-Party Marketing Partners’ website pages (collectively, “Tracking Technology”). As further detailed below, the Tracking Technology can be used to, among other things, count the number of users that have visited a certain web page, accessed a certain piece of LS Direct Marketing creative or Third-Party Marketing Partners’ creative, and monitor consumer activity on a website page. We place cookies on consumer devices and relate those devices to the consumer’s email address, and ultimately their name and physical address.

How We Use Collected Data

We may provide the data we have collected and received from third parties (“Data”) to any third party and we may work with other businesses to bring selected retail opportunities to our users. These businesses and third parties may include, but are not limited to: (a) providers of direct marketing services and applications, including lookup and reference, data enhancement, suppression and validation; (b) email marketers; (c) telemarketers (where we collect your telephone number and where permitted by applicable law); (d) SMS text-based marketers (where we receive your mobile telephone number and where permitted by applicable law); and (e) direct marketers.

We may also employ other companies and individuals to perform certain functions on our behalf. Examples include printing, sending direct and electronic mail, removing duplicate information from user lists, analyzing data and providing marketing analysis. The agents performing these limited functions on our behalf shall have access to the Data as needed to perform their functions for us, but we do not permit them to use capture data for other purposes.

We will use capture data to help our Third-Party Marketing Partners provide you with customer service, provide you with information that you may request. We may also use capture data for internal business purposes, such as analyzing and managing our business.

We may also combine Data about you with information from other sources including, without limitation, our Third-Party Marketing Partners and Tracking Technology (as defined above).

We reserve the right to release current or past user Data in the event that we believe that the user is using, or has used, our products, services and/or website: (i) in violation of the LS Direct Marketing Site Policy, Promotion contest rules, this Privacy Policy or any other of our operating rules, policies, price schedules and other supplemental terms and conditions or documents that may be published by us from time to time; (ii) to commit unlawful acts; (iii) if such information is subpoenaed or requested pursuant to a judicial or regulatory proceeding or inquiry; (iv) if we are if we are involved in a sale, acquisition, merger, reorganization or sale of assets or in the event of bankruptcy; and/or (v) when we deem it necessary or appropriate including, without limitation, sharing your email address with other third parties for suppression purposes in compliance with the CAN-SPAM Act of 2003, as amended from time to time, and Federal Trade Commission implementing regulations.

We do not capture user data associated with IP address known to be from GDPR regulated countries.

Behavioral Targeting/Uses of Data and Tracking Technology

LS Direct Marketing reserves the right to share, rent, sell, distribute and/or use capture data for any and all lawful purposes. We use Tracking Technology to help us better monitor email activities and the activities of visitors to our Third-Party Marketing Partners’ websites and determine which marketing material is effective and preferred by our respective users and their customers. Without limiting the foregoing, we use Tracking Technology in our LS Direct Marketing creative as well as our Third-Party Marketing Partners’ creative to inform us of which email messages have been opened by recipients so that we may gauge the effectiveness of the applicable email-based activities. In addition, we and our Third-Party Marketing Partners may use Tracking Technology to track your Internet-related activities for the purpose of providing you with tailored advertisements that match your demonstrated areas of interest.

To this end, we may share hashed or anonymized user data from email communications or website activities with third-parties so they may set cookies and/or collect user data directly from the user (e.g. through a cookie or other technology) for their own use and subject to their own privacy policies. The user data may be combined and linked with data from other sources.

Security

Users may find advertising or other content on our Site that link to the sites and services of our partners, suppliers, advertisers, sponsors, licensors and other third parties. We do not control the content or links that appear on these sites and are not responsible for the practices employed by web sites linked to or from our Site. In addition, these sites or services, including their content and links, may be constantly changing. These sites and services may have their own privacy policies and customer service policies. Browsing and interaction on any other web site, including web sites which have a link to our Site, is subject to that web site’s own terms and policies.

Suppression of Your Data/Opting Out
